First-tier Tribunal (Property Chamber): what it does and where to apply

Residential property disputes it handles

GOV.UK lists the residential matters the Property Chamber deals with, including:

• rent increases for "fair" or "market" rates
• leasehold disputes and leasehold enfranchisement
• disputes about park homes
• improvement notices and prohibition orders where the notice is under the Housing Act 2004
• disputes about licences for houses in multiple occupation
• refusal of the right to buy a council home on the basis that it is deemed suitable for elderly people

The same chamber handles land registration matters — disputes over a change to the land register, and applications to correct or cancel certain documents relating to registered land — as well as agricultural land and drainage matters, including disputes between agricultural tenants and landlords in relation to certain farming tenancies. It also handles applications from valuation officers to enter premises to carry out certain valuations.

Why it matters to private landlords

Two routes are the ones private landlords in England meet most often. The first is an appeal against a financial penalty imposed by a local housing authority — for example under the Housing Act 2004 or the Electrical Safety Standards regime. The second is a rent repayment order application made against a landlord, which the tribunal decides.

How to apply and where to read the rules
