Can landlords increase rent by CPI automatically? No. Since 1 May 2026, a clause in an assured tenancy that increases the rent is of no effect unless the increase is made by a Section 13 notice (Form 4A), a tribunal determination or agreement with the tenant. A Section 13 increase cannot take effect less than 52 weeks after the last one. See section 13 of the Housing Act 1988 (legislation.gov.uk).

Does the Renters' Rights Act change this? Yes. Since 1 May 2026, all private rent increases use the Section 13 process, and tenants can challenge an increase at the First-tier Tribunal.
