Assured Periodic Tenancy Agreement — Free Template

A free, fillable assured periodic tenancy agreement for England. Since 1 May 2026 all new private rented tenancies in England are assured periodic tenancies under the Renters' Rights Act 2025. This template combines the agreement itself with the written statement of terms prescribed by SI 2026/324 under section 16D of the Housing Act 1988 — so completing it covers both documents in one.

Before you fill this in

This is a template tenancy agreement for a private rented dwelling in England let on an assured periodic tenancy. Since 1 May 2026, new private rented tenancies in England can no longer be assured shorthold tenancies or granted for a fixed term — they are assured periodic tenancies under the Renters' Rights Act 2025.

Section 16D of the Housing Act 1988 requires the landlord to give the tenant a written statement of the terms prescribed by SI 2026/324. GOV.UK guidance confirms the statement may be contained within the tenancy agreement — which is how this template is built. Part 1 sets out the operative terms of the tenancy; Part 2 contains the prescribed written statement; Part 3 is the signing page.

This template is general information, not legal advice. A tenancy agreement is legally binding on both parties — if your circumstances are unusual (company let, room-only HMO arrangements, resident landlord, supported accommodation), take advice from a qualified solicitor before using it.

Part 1 — The agreement (fill in every field)

This agreement creates an assured periodic tenancy of the property under Part 1 of the Housing Act 1988 as amended by the Renters' Rights Act 2025. The tenancy runs from period to period with no fixed term.

Part 1 continued — Core terms of the tenancy

The following terms reflect the statutory framework. Do not delete the statements marked as prescribed — they are required content for the written statement under SI 2026/324.

  • Rent: the tenant must pay the rent stated in Part 1 on the due date. If the landlord proposes to increase the rent, the landlord must serve a notice on the tenant in accordance with section 13 of the Housing Act 1988. (Prescribed statement.)
  • Security of tenure: in most circumstances the landlord can only bring the tenancy to an end by obtaining an order of the court for possession of the property and the execution of the order. If the landlord seeks such an order, the landlord (or, for joint landlords, at least one of them) must usually serve a notice of proceedings for possession in the prescribed form specifying the ground or grounds of possession, and those grounds determine the minimum period of notice, if any, that must be given before proceedings are begun.   • Fitness for human habitation: the landlord is under an obligation to ensure the property is fit for human habitation, to the extent required by section 9A of the Landlord and Tenant Act 1985. (Prescribed statement.)
  • Repairs: the landlord is under an obligation, to the extent required by section 11 of the Landlord and Tenant Act 1985, to keep in repair the structure and exterior of the property, to keep in repair and proper working order the installations for the supply of water, gas and electricity and for sanitation, and to keep in repair and proper working order the installations for space heating and heating water. (Prescribed statement.)
  • Electrical safety: the landlord must ensure relevant electrical safety standards are met during any period when the property is occupied, ensure relevant electrical installations are inspected and tested by a qualified person at least every five years (or earlier if the most recent report requires), obtain a report giving the results and the date of the next required inspection and test, and supply a copy of that report to the tenant. (Prescribed statement, where the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 apply.)
  • Gas safety: where there is a relevant gas fitting in or serving the property, the landlord must maintain in a safe condition any relevant gas fitting and any relevant flue, ensure each appliance and flue is checked for safety at the required intervals by, or by an employee of, a member of a class of persons approved by the Health and Safety Executive, and ensure a record of each check is made and, subject to exceptions, a copy given to the tenant. (Prescribed statement, where the Gas Safety (Installation and Use) Regulations 1998 apply.)
  • Improvements for disabled occupiers: under section 190 of the Equality Act 2010 the landlord may not unreasonably withhold consent to a request by the tenant to make an improvement to the dwelling-house where a disabled person occupies or intends to occupy the dwelling-house as that person's only or main residence and the improvement is likely to facilitate that person's enjoyment of the premises or of any part of the premises, having regard to the disability, and that section 190 does not apply in so far as provision of a like nature is made by the tenancy. (Prescribed statement, where it applies.)
  • Pets: in accordance with section 16A of the Housing Act 1988, the tenant may keep a pet at the property if the tenant asks to do so in accordance with that section and the landlord consents, and such consent is not to be unreasonably refused. (Prescribed statement.)
  • Deposit: any deposit must be protected in a government-approved tenancy deposit scheme and the prescribed information given to the tenant within 30 days, as required by sections 212–215 of the Housing Act 2004.
  • Tenant's notice to quit: the tenant may end the tenancy by giving the minimum notice stated in Part 1, in line with section 5 of the Protection from Eviction Act 1977 where it applies.

Part 2 — Written statement of terms (SI 2026/324)

Completing Part 1 and keeping the prescribed statements in place satisfies the duty under section 16D of the Housing Act 1988 to give the tenant a written statement of the prescribed terms. GOV.UK guidance states the statement may be contained within the tenancy agreement.

Part 3 — Signatures

Both parties should sign and date. Give the tenant a copy of the whole signed agreement before the tenancy begins, together with the other documents GOV.UK requires (for example the current Renters' Rights Act Information Sheet, which replaced the withdrawn How to Rent guide on 1 May 2026, the gas safety certificate, the EICR and the EPC).

Related duty — existing tenancies

Tenancies that converted to assured periodic tenancies on 1 May 2026 are covered by a separate transitional duty: the landlord must give the tenant the current version of 'The Renters' Rights Act Information Sheet 2026' (regulation 3 of SI 2026/324).
