How much rent arrears is Ground 8 in England? Since 1 May 2026, at least three months' rent unpaid where rent is payable monthly, or at least 13 weeks' rent where it is payable weekly or fortnightly. The arrears must reach that level both when the section 8 notice is served and at the hearing (Housing Act 1988, Schedule 2, Ground 8, as amended by the Renters' Rights Act 2025).

How much notice must I give for rent arrears? Four weeks for the rent-arrears grounds under section 8 of the Housing Act 1988, beginning with the date the notice is served.

Does delayed Universal Credit count towards the arrears? No. Where the tenant is entitled to a housing amount as part of a Universal Credit award, any rent unpaid only because that payment had not yet been received by the tenant is ignored when calculating arrears for Ground 8.

Are there other rent arrears grounds? Yes. Ground 10 (some rent unpaid) and Ground 11 (persistent delay in paying rent) are discretionary — the court may order possession but does not have to — and carry the same four-week notice period.
